Terms of service
1. The service
EpicRally Tennis ("EpicRally", "the game") is a tennis game that runs in your web browser at epicrallytennis.com. It includes play against a computer opponent, a training Academy, and online matches between players. By using the game you agree to these terms and to our privacy policy.
2. Who may play
Anyone may play as a guest. Creating an account requires you to be 13 or older. If you are under the age at which you can agree to these terms where you live, a parent or guardian must agree for you.
3. Accounts
- You sign in with your e-mail address (a code we send you) or through a sign-in provider such as Google or Facebook. Keep access to that mailbox or provider account: it is your key.
- One account per person. Your display name must be unique, must not impersonate someone else, and must not be offensive; we may rename or remove names that break this.
- You are responsible for what is done from your account. Sign out on shared computers ("Sign out everywhere" in the Account screen ends every session).
- You can delete your account at any time (Account → Delete account, or see how to delete your account).
4. Fair play
- Online matches run between the two players' browsers. Do not modify the game, automate play, exploit bugs, or interfere with another player's connection. Matches in which the two sides' game states disagree may be voided.
- Be decent to other players: display names and any future chat must not be abusive, hateful or sexual.
- We may suspend or close accounts that break these rules, with notice where the law requires it.
5. The Club membership
When available, the Club is an optional paid membership that unlocks additional content and online features. Prices are shown before you pay. Payments are processed by Stripe under its terms; recurring memberships renew until cancelled and can be cancelled at any time from the Account screen, with effect at the end of the period already paid. Refunds follow the law of your country of residence (for example the 14-day right of withdrawal for EU consumers, where it applies) and are otherwise at our discretion. Nothing in the Club affects the outcome of a rally — no pay-to-win.
6. Content and intellectual property
The game, its code, artwork, sounds and text belong to Nkemtasoft, LLC or its licensors. We grant you a personal, non-exclusive, revocable licence to play the game through the site. Your display name and any content you provide remain yours; you allow us to show them in the game (for example in live scores) as the feature requires.
The game's assets — 3D models, animations, textures, sounds and the data files that carry them — are licensed to you for play inside the game only. You may not download, extract, copy, modify, redistribute or use them outside the game, or circumvent the measures that protect them. Some assets are licensed to us by third parties (listed at humans.txt); their terms apply too. To report an infringement or request a takedown, write to [email protected].
7. Availability and changes
The game is provided "as is". We work to keep it available and may change, suspend or discontinue features at any time; online play needs our lobby service and your opponent's connection, neither of which we can guarantee. We may update these terms; the effective date above changes when we do, and continued use after a change means you accept it.
8. Liability
To the extent the law allows, Nkemtasoft, LLC is not liable for indirect or consequential losses arising from the use of the game, and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, including your statutory rights as a consumer.
9. Governing law
These terms are governed by the laws of the State of Delaware, USA, without prejudice to mandatory consumer protections of the country where you live.
